Privacy policy

This website is operated by AGent Sales & Services Pty Ltd, ABN 49 056 416 043 (AGent, we, us) of 38 May Holman Drive, Bassendean WA 6054. We are bound by the Privacy Act 1988 (Cth) and the Australian Privacy Principles. This policy explains what personal information we collect through this site, why, and how we handle it.

What we collect

Trade account and contact enquiries. When you use the form on our Contact page we collect your name, business name, phone number, email address, business type and anything you write in the message field.
Phone and email contact. If you call or email us we keep the details needed to deal with your enquiry or order.
Technical information. Our hosting provider logs standard web-server data such as your IP address, browser type, the pages requested and the time of the request. We use this only to keep the site running and secure.

We do not collect sensitive information through this site, and we do not knowingly collect information from anyone under 18.

Cookies and similar technologies

This site does not use analytics, advertising or tracking cookies. The only thing it stores in your browser is your light or dark display preference, if you set one with the header toggle. That setting stays on your device and is never sent to us.

Why we collect it and how we use it

To respond to your enquiry, set up and manage a trade account, and supply and invoice products.
To send you information about products, pricing and supply that is relevant to your business. You can ask us to stop at any time.
To meet our legal obligations, including record-keeping and dangerous-goods requirements.
To keep the site running and secure.

Who we share it with

We do not sell personal information. We share it only with service providers who help us run the business, and only to the extent they need it:

Website hosting and forms. This site and its contact form are hosted by Netlify, Inc., whose servers are located outside Australia, including in the United States. Form submissions are stored on Netlify's systems and sent to us by email. By submitting the form you consent to your details being transferred to and stored on those systems.
Email and business systems. We use Microsoft 365 for email and document storage, and our business management system for accounts and orders.
Delivery and credit. Trade account details may be shared with our freight carriers to deliver orders and with our credit reporting provider, CreditorWatch, to assess and manage trade credit, as permitted by the Privacy Act and the Credit Reporting Code. Our credit reporting policy is available on request.
Where the law requires it, for example to a regulator or under a court order.

Storage and security

We take reasonable steps to protect personal information from misuse, interference, loss, unauthorised access, modification and disclosure, including access controls on our systems and limiting who can see enquiry and account information. No method of transmission over the internet is completely secure, so we cannot guarantee absolute security.

Access, correction and complaints

You can ask us for a copy of the personal information we hold about you, or ask us to correct it, by calling (08) 6270 4500 or writing to us at the address above, marked to the attention of the General Manager. We will respond within a reasonable time, normally 30 days.

If you believe we have mishandled your personal information, please contact us first so we can try to resolve it. If you are not satisfied with our response you can complain to the Office of the Australian Information Commissioner at oaic.gov.au.

Changes to this policy

We may update this policy from time to time. The date at the top of this page shows when it was last changed, and the current version is always the one published here.

Website terms

By using this site you agree to these terms. If you do not agree, please do not use the site.

Who the site is for

This site is written for the pool and spa trade: pool shops, mobile technicians and commercial operators. We supply the trade and do not sell to the public through this site. Pricing is by trade account only.

Guides, tools and calculators are general information

The field guides, calculators and other technical content on this site are general information for trade professionals. Every pool, spa and site is different, and the content cannot take account of the conditions at yours. It does not replace:

the product label and the safety data sheet (SDS) for any chemical you use;
the manufacturer's installation and operating manual for any equipment;
advice from a licensed electrician, plumber or other qualified tradesperson where the work requires one; or
the requirements of the regulator, local government or water authority that apply to the pool you are working on.

Figures quoted from the WA Health Code of Practice for the design, construction, operation, management and maintenance of aquatic facilities apply to public aquatic facilities. They are quoted as a benchmark for other pools, not as a requirement. Calculator results are estimates based on the figures you enter and the assumptions stated on the Tools page. Check them against your own measurements and the equipment manual before you act on them.

Safety data sheets

The SDS library holds the versions current when they were uploaded. The SDS supplied with the product, or the latest version available from us on request, always takes precedence. Always read the label and the SDS before handling, storing or using any chemical.

Liability

To the extent permitted by law, AGent excludes all liability for any loss, damage, injury, cost or expense, whether direct, indirect or consequential, arising from the use of this site or reliance on anything on it. Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded by agreement. Where our liability cannot be excluded but can be limited, it is limited, at our option, to re-supplying the relevant goods or services or paying the cost of having them re-supplied.

This site links to government, regulator and manufacturer websites and documents for your convenience. We do not control them and are not responsible for their content or for changes made to them after we linked to them.

The content of this site, including its text, guides, calculators and their underlying models and data, photographs and design, is owned by or licensed to AGent and is protected by copyright. You may view and print pages for your own business use. You may not otherwise copy, reproduce, scrape, republish or commercially exploit any part of the site without our written permission. AquaGUARD and the AGent logos are our marks. Other product names mentioned on the site are the marks of their respective owners and are used only to identify those products.

Governing law

These terms are governed by the laws of Western Australia, and you submit to the non-exclusive jurisdiction of its courts.
